Audience Terms
Rules for audience pages, requests, shoutouts, tips, paid interactions, and audience conduct.
These Audience Terms apply when a person scans an Artist's GigStage QR code, opens an audience page, submits a song request or shoutout, tips an Artist, or makes another payment through GigStage.
1. Agreement to these Terms
By submitting an audience interaction or completing a payment, you agree to these Audience Terms and acknowledge the Privacy Policy.
Do not use GigStage if you do not agree.
2. About GigStage
GigStage provides technology that allows live performers to receive and organize audience requests, shoutouts, tips, paid interactions, and related engagement.
GigStage provides the platform. The Artist remains responsible for the performance and decides how audience interactions are handled.
3. Artist control and performance discretion
Paid requests support the artist. Completion depends on the remaining gig time, queue volume, timing, and flow of the live event.
Artists retain complete artistic and performance discretion. A request, shoutout, tip, or payment does not require an Artist to play a song, play it completely, play it at a particular time, deliver a shoutout, alter a setlist, extend a performance, or interrupt the flow of the event.
4. Song requests
An Artist may choose which songs are available. Requests may be grouped, counted, skipped, delayed, marked played, hidden, removed, or left incomplete.
A song may not be performed because of time, performance flow, queue volume, venue restrictions, available instruments or performers, song suitability, safety, licensing, or another reasonable performance decision.
GigStage does not guarantee that a higher payment will cause a request to be performed sooner.
5. Shoutouts
A shoutout may be skipped, shortened, paraphrased, delayed, marked complete, or left incomplete.
Do not include private contact details, sensitive personal information, harassment, threats, hate, sexual exploitation, defamatory accusations, illegal instructions, impersonation, advertising, spam, or content that could place someone at risk.
6. Tips
A tip is a voluntary payment intended to support the Artist.
Unless expressly stated otherwise, a tip is not payment for a particular song, does not guarantee a shoutout or additional performance, and does not give the audience member control over the Artist.
7. Paid requests and paid shoutouts
Paid requests and shoutouts combine support for the Artist with a submitted preference or message.
By completing a paid interaction, you acknowledge that the interaction may not be completed, the Artist controls the performance, event circumstances may change, the Live Gig may end first, and inappropriate submissions may be removed.
8. Prices, currencies, and authorization
Before payment, review the amount, currency, Artist, selected interaction, payment method, and notices shown at Checkout.
You confirm that you are authorized to use the payment method, the information is accurate, the transaction is not fraudulent, and you understand what the payment supports.
9. Stripe payment processing
Stripe processes audience payments and may receive card information, billing details, transaction information, device and network information, and fraud-prevention signals.
GigStage does not receive or store complete card numbers or card security codes. Stripe may approve, decline, delay, review, reverse, or restrict a payment.
10. Payment status
Opening Checkout does not complete a payment. A payment may be completed, processing, declined, cancelled, abandoned, expired, refunded, disputed, or reversed.
Cancelled, unpaid, abandoned, or expired Checkout Sessions do not create completed Artist earnings.
Do not repeat a payment only because a page appears slow. Check for confirmation first.
11. Refunds
Ordinary refund decisions are generally made at the Artist's discretion, subject to law, Stripe requirements, and the Payment and Refund Policy.
A request not being performed does not automatically create a refund right because the payment supports the Artist and completion depends on the live event.
GigStage may process a refund where necessary to comply with law, correct a duplicate or technical charge, address confirmed fraud, follow a payment-network requirement, or prevent material harm.
12. Disputes and chargebacks
You may have rights through your bank or card issuer. Contact GigStage support first where reasonably possible so the issue can be investigated.
Do not misuse a dispute merely because a request was not played, was not immediate, was performed differently, or the event ended before completion.
Nothing prevents a legitimate dispute involving fraud, unauthorized use, duplicate charging, material misrepresentation, or another legally valid reason.
13. Names and privacy
Audience names are optional unless a feature clearly states otherwise. You may use a nickname.
Do not submit email addresses, phone numbers, home addresses, payment details, government identifiers, medical information, passwords, or other sensitive information in requests or shoutouts.
Artists normally see only the limited information needed for the interaction, such as an optional name, request, shoutout, amount, and payment status.
14. Younger audience members
A person under the legal age required to authorize a payment must obtain permission from a parent or legal guardian.
A child who cannot meaningfully understand the collection and use of personal information should not submit personal information without adult involvement.
15. Acceptable audience conduct
- Do not harass, threaten, stalk, intimidate, or submit hateful, discriminatory, exploitative, defamatory, unlawful, or privacy-invasive content.
- Do not impersonate others, send spam, manipulate request counts, automate submissions, evade rate limits, test stolen payment methods, abuse refunds, attack the platform, or interfere with a performance.
16. Audience-submitted content
You retain rights you have in submitted content and grant GigStage and the relevant Artist a limited, non-exclusive licence to display, transmit, organize, review, and use it as reasonably necessary to provide the interaction, investigate complaints, and preserve required records.
You confirm that you have the right to submit the content and that it does not violate another person's rights.
17. Public-event awareness
Live events are public or semi-public. An Artist may speak a submitted name, message, or request aloud.
Do not submit information you would not want heard by others. GigStage is not responsible for audience, venue, livestream, or third-party recordings.
18. Artist and venue responsibility
The Artist, venue, promoter, and event operator remain responsible for their activities. GigStage does not operate the venue, manage crowd safety, supervise alcohol service, control admission, guarantee accessibility, employ the Artist, or manage performance licensing.
19. Service availability
GigStage may be delayed or unavailable because of cellular service, venue Wi-Fi, devices, browsers, maintenance, errors, provider interruptions, security restrictions, or circumstances outside GigStage's control.
20. Restricted access
GigStage may block or restrict a device, network, session, payment method, or submission because of abuse, fraud, excessive requests, prohibited content, payment risk, Artist suspension, legal requirements, or security concerns.
An Artist may pause requests or end a Live Gig at any time.
21. Intellectual property
GigStage software, branding, design, and platform materials are owned by or licensed to GigStage.
You may not copy the service, extract source code, scrape data, bypass restrictions, reproduce branding, or commercially exploit GigStage materials without permission.
22. Disclaimer of warranties
To the maximum extent permitted by law, GigStage is provided as is and as available.
GigStage does not guarantee request completion, shoutout delivery, Artist availability, uninterrupted service, error-free payments, a particular event experience, or the accuracy of Artist-provided information.
23. Limitation of liability
To the maximum extent permitted by law, GigStage will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from an incomplete interaction, Artist decision, audience content, venue incident, network loss, payment delay, third-party recording, or another user's conduct.
Where liability cannot be excluded, GigStage's total liability relating to a particular audience transaction will not exceed the greater of the amount paid through that transaction or CAD $25.
24. Responsibility for conduct
To the extent permitted by law, you are responsible for claims or losses resulting from content you submit, fraudulent payment activity, unauthorized payment use, infringement, harassment, unlawful conduct, privacy misuse, platform attacks, or a material breach.
25. Changes
The current version will display a version number and effective date. Material changes affecting payment expectations, privacy, refunds, or legal rights may be presented before a future submission or payment.
A completed transaction remains associated with the version presented when it was authorized, subject to mandatory law.
26. Governing law
These Terms are governed by the laws of Alberta and the applicable federal laws of Canada.
Subject to mandatory consumer rights, disputes will be handled by the courts located in Calgary, Alberta.
